BECOMING A MEMBER AND REGISTERING ON THE WEBSITE.

Accessing the Site and Becoming a Member. THE WEBSITE IS INTENDED SOLELY FOR ACCESS AND USE BY INDIVIDUALS 18 YEARS OF AGE AND OLDER. BY ACCESSING AND USING THE WEBSITE, YOU ARE CERTIFYING THAT YOU ARE AT LEAST 18 YEARS OLD. While there are parts of the Website that are available only to individuals who purchase a fee-based membership and services, there is no cost to register on our Website or use our non-fee based services (collectively, the"Services"). Disputes
The Agreement shall be governed by, and construed in accordance with, the laws of the State of California, without regard to its conflict of law provisions. You and Safar.com agree to submit to the exclusive jurisdiction of the courts located within the State of California to resolve any dispute arising out of the Agreement or the Safar.com Services. Any dispute You may have with respect to this Site must be commenced within one year after it arises, or the cause of action is barred.

Applicable Law
Safar.com shall be exclusively governed by and construed in all respects under the laws of the State of California, without giving effect to any choice-of-law or conflict-of-laws provisions. You agree that the laws of the state of California, without regard to conflicts of laws provisions will govern these Terms and Condition of Use and any dispute that may arise between you and Safar.com or its affiliates.
You further agree to submit to the personal jurisdiction of the state courts located in San Fernando Valley, California and the personal jurisdiction of the federal courts located within Central District of California for any and all legal claims, suits or actions that arise in connection with this Service or from a dispute as to the interpretation or breach of the Safar.com.

Attorneys’ Fees
If any legal action relating this web site and/or the Terms of Use, including arbitration or an action for declaratory relief, is brought to enforce or interpret the provisions of this Agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees from the other party. These fees, which may be set by the arbitrator(s) or court in the same action or in a separate action brought for that purpose, are in addition to any other relief to which the prevailing party will be entitled. This provision applies to the entire Agreement.

Indemnity
You agree to indemnify and hold Safar.com, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Safar.com Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or if any Content that you post on or through the Safar.com Services causes Safar.com to be liable to another.

Member Eligibility; Accuracy of Information
Our services may only be used by members who can form legally binding contracts under applicable law. As Safar.com is dependent upon the information supplied to us by advertisers and other users entered by them direct into our systems, we must make the following disclaimers:

Safar.com makes no representation as to the accuracy or currency of the information contained on the Safar.com web site and all conditions and warranties whether express or implied, statutory or otherwise are hereby expressly excluded with regard to the information contained on these pages, including but not limited to, all implied warranties of satisfactory quality and fitness for purpose. The accuracy of the information on the Safar.com web site and other sites in the network linked to from this site, is the sole responsibility of the advertisers and Safar.com has not verified the accuracy thereof. Photographs
By submitting a photograph either electronically through the Site or by mailing a paper photograph to our offices, the member represents and warrants that (a) (i) it holds all intellectual property rights with respect to each submitted photograph, or (ii) it has secured from the copyright holder all rights necessary for the photograph to be used in an online advertisement, (b) that any people in the photograph have given permission for their likeness to be displayed in an online advertisement, (c) that the photograph accurately and fairly represents the subject of the photograph and has not been altered in any manner that would mislead a viewer of that photograph, and (d) that it will indemnify and hold harmless the Site and any member of the Safar.com from any cause of action arising from any misrepresentation with respect to any and all the photographs so submitted.

Vacation Renatal Disclaimers

Complaints from Renters
 Safar.com reserves the right to cancel any Safar.com listing. In most cases, this would only occur if complaints are received from property renters; however, Safar.com reserves the right to cancel any membership at its sole discretion and for any reason.

Avoiding problems
Make sure you have a contact telephone number of some one to contact locally during your stay. If something goes wrong, or you are not happy with some aspect of the property on your arrival or during your stay, call this contact and give them the chance to put things right.

Property Listings
Owners are responsible for the accuracy of the information on their property listings. Owners who provide photos to be used assert that the photos are their own property and these same owners have the publishing rights to said photos. Safar.com is not responsible for any action, or omission of action, by any renter obtained by the use of this site.

Grant of License
By submitting an advertisement, listing or content associated with said listing or advertisement to Safar.com you represent that you own the right to use content associated with said listing or advertisement and grant Safar.com a world-wide, royalty free, non-exclusive license to use, distribute, reproduce, modify, adapt and publicly display such an advertisement, listing or content associated with said listing or advertisement on this web page. Said license shall continue in perpetuity and shall not terminate on the cancellation or expiration of the advertisement or listing.

Identity Verification
User verification on the Internet is difficult and we cannot and do not confirm each user's purported identity. We encourage you to communicate directly with a traveller or member through the tools available on the Site.

No Warranty
Safar.com LISTINGS ALL PROVIDED “AS IS” AND AT YOUR SOLE RISK. Without limiting the foregoing, we do not promise that  will work properly or continuously. Some jurisdictions do not allow warranty exclusions, so they may not apply to you.

Limitations of Use of Other User's Information; No Spam.
 You agree that, with respect to other users' personal information that you obtain through the Site or through any Site-related communication or any Site-facilitated transaction, we have granted to you a license to use such information only for: (a) any Site-related communications that are not unsolicited commercial messages, (b) using services offered through the Site, (c) facilitating a financial transaction between you and the other user (such as an on-line booking or charging a personal credit card) and (d) any other purpose that a user expressly agrees to after you tell them the purpose you would like to use it for.
